Duo Dev Technologies ("we," "us," "our") respects the intellectual property rights of others and expects all users of ToolByte to do the same. This policy outlines the procedures for reporting copyright infringement on our platform in accordance with the Digital Millennium Copyright Act (DMCA) of 1998 (17 U.S.C. S 512) and the Indian Copyright Act, 1957 (as amended).
ToolByte is a tool-processing platform where users submit content for real-time processing (minification, formatting, conversion, analysis, etc.). We generally do NOT store user-submitted content on our servers after processing. However, certain features may allow content uploads, and our platform itself contains copyrighted content (code, design, documentation).
If you believe that your copyrighted work has been used on or through ToolByte in a manner that constitutes copyright infringement, this policy describes how you can request removal.

5. Repeat Infringer Policy
In accordance with the DMCA and applicable laws, we maintain a policy for terminating the accounts of users who are repeat copyright infringers:
• First offense: Warning notification and removal of infringing material
• Second offense: Temporary account suspension (30 days) and removal of infringing material
• Third offense: Permanent account termination and ban from the Service
We track infringement notices associated with user accounts and IP addresses. We exercise reasonable judgment in determining what constitutes a "repeat infringer," taking into account any counter-notifications or successful appeals.

6. Good Faith Requirement
For Copyright Owners: Filing a DMCA takedown notice is a serious legal action. Under Section 512(f) of the DMCA, any person who knowingly makes a material misrepresentation in a takedown notice may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer.
Before filing a DMCA notice, please consider whether your use of the copyright claim is appropriate, whether you are the actual copyright owner or have proper authorization, and whether the material is actually infringing.
For Counter-Notifiers: A counter-notification is also a sworn legal statement. Filing a false counter-notification under penalty of perjury may result in legal liability. Only submit a counter-notification if you genuinely believe the material was removed by mistake or misidentification.

7. Indian Copyright Law Provisions
As Duo Dev Technologies is based in India, this DMCA Policy also operates within the framework of Indian copyright law:
• Copyright Act, 1957 (India): We comply with the provisions of the Indian Copyright Act, including Section 51 (copyright infringement) and Section 52 (fair dealing exceptions)
• Information Technology Act, 2000 (India): As an intermediary under the IT Act, we follow the Intermediary Guidelines and Digital Media Ethics Code, 2021, for handling copyright complaints
• Grievance Redressal: Copyright-related complaints will be acknowledged within 24 hours and resolved within 15 days, in compliance with Indian intermediary guidelines
• Safe Harbor: We claim safe harbor protection under Section 79 of the IT Act, 2000, provided we act in accordance with due diligence requirements upon receiving actual knowledge of infringing content
If you are filing a complaint under Indian law rather than the DMCA, the same contact information and general procedure apply. Please specify in your notice that your complaint is filed under the Indian Copyright Act, 1957.

8. Limitations and Clarifications
Real-Time Processing: ToolByte primarily processes user-submitted content in real-time without storing it. This means in most cases, there is no persistent copy of user-submitted content on our servers that can be "removed." DMCA notices are most relevant to content that appears on our website itself (e.g., visual assets, documentation, blog content) or content stored through specific features that retain user data.
Tool Output: If a user uses our tools to process copyrighted content (e.g., minifying copyrighted code), the processing occurs transiently and the output is delivered directly to the user. We do not retain copies of processed content, and therefore cannot remove output that no longer exists on our systems.
Not Legal Advice: This DMCA Policy is provided for informational purposes. It does not constitute legal advice. If you have questions about copyright infringement or the DMCA process, we recommend consulting a qualified attorney.
